Radon in Illinois Law

The radon industry in Illinois is strictly regulated by the state. Anyone who is paid to test or mitigate radon, or provides lab services for radon products, is required to obtain and maintain a state license. The Illinois Emergency Management Agency Division of Nuclear Safety (IEMA DNS) Radon Program oversees all the state licensees.

This oversight protects both consumers and good radon service providers and we appreciate their efforts.

Illinois Radon Awareness Act

  1. A Radon Warning Statement advising the buyer that the property may present exposure to dangerous levels of indoor radon gas and may place the occupants at risk of developing radon-induced lung cancer.
  2. Signed acknowlegment by the real estate agents that they have informed the seller of the seller’s obligations under Illinois law.
  3. The Seller provide an IEMA approved Radon Disclosure Pamphlet to the buyer.
  4. The Seller disclose any knowledge and provide any available documentation of radon test results from the home.
  5. All parties in the transaction, including all real estate agents, sign the document acknowledging the transfer of the required information.

The Act does not require that all homes in a real estate transaction be tested or that the home be mitigated if the test results are elevated.
